Welcome to the AllFloorsExpress.co.uk website terms and conditions for use. We aim to give you the best possible value and service at all times. The following terms and conditions will explain how we will deal with your order and you should read them carefully. They can be viewed at any time by clicking the terms and conditions link at the bottom of each page.These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

You warrant that:

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

By placing an order with Us, you are accepting these Terms, as well as our Privacy Policy.Once you’ve placed your order, we will acknowledge your order immediately by email.This is to inform you that we’ve received your Order and one of our agents will be processing it. We will then contact you again, normally within 2 working days, and give details of proposed delivery or fitting date. Neither of these communications mean that we have legally accepted your Order. Acceptance of your Order, and the completion of the Contract, will take place when we despatch the Goods to You (or some of them if we’re delivering in instalments).
You are responsible for all activities which occur under your customer username and password, save where such activities occur as a result of our negligence or fault.
Acknowledgement of your Order is not a guarantee by us of the availability of the Goods. If you receive an acknowledgment email or confirmation email for an Order which you did not place, or if the details in the acknowledgment email or confirmation email do not match the Order which you placed, you must contact our sales department at sales@allfloorsexpress.co.ukor alternatively you can Contact Us by phone on 0845 1297971to cancel the Order or correct the details.
We do our utmost to ensure that all our web prices and descriptions are accurate and up to date but on rare occasions it is possible that errors may occur. Any omission or error in any sales literature, web page or site, order form, quotation, price list, order acknowledgement, dispatch note, invoice or other document issued by us may be corrected by us without liability. Our sales team will check the details of your order and if we find that there is a pricing or other error we will notify you as soon as possible and give you the choice to proceed with your order at the correct price/specification or to cancel your order and obtain a full refund. If we do not receive a response to this notification within seven days we will cancel the order and issue a refund of your payment.

PAYMENT
Online payments may be made by debit or credit card. Payment using a debit or credit card is taken at the time you place your order and is processed using an independent company’s secure payment processing system. We do not see, or have access to, any of your payment card information.
All prices are shown in £s sterling and include VAT, where applicable, at the applicable current rates. Any delivery charges are clearly marked where applicable. Payment will only be accepted in £s sterling.

DELIVERY
When your order has been confirmed we will supply an anticipated delivery/fitting date. We will always look to provide realistic and achievable dates that are agreeable to both you and us, in the knowledge that the successful scheduling of deliveries and fitting is key to providing customer satisfaction. However such dates are given in good faith but are only estimates and they are not guaranteed dates and should not be relied upon as such. Time is not of the essence of the contract and we will not accept liability for any losses unless we fail to deliver within a reasonable time. If the expected delivery date is likely to, or does, exceed 30 days you will be contacted by us and you will be able to either agree a longer timescale or cancel your order if you wish and receive a full refund of the monies you have paid.
Upon delivery please check that there is no obvious damage to the packaging that could have caused the goods inside to be damaged themselves. If upon inspection you have any doubts about the goods please contact us immediately. In all cases genuine complaints will be dealt with in good faith, but your rights may be adversely affected if you do not contact us as soon as possible.

CANCELLATIONS AND RETURNS
The Consumer Protection (Distance Selling) Regulations 2000 (as amended 2005)
By purchasing over the internet or by telephone you are entering into a “Distance Sale”. In addition to your normal statutory rights as a consumer you also have the right to cancel the contract at any time up to seven working days after the date your order is delivered to you by contacting us by email at sales@allfloorsexpress.co.uk or by phone on 0845 1297971.
This right does NOT apply to products specifically made to your specifications and this includes carpet and domestic vinyl which have been cut from a roll to your specific order size.

Please use our FREE sample service to ensure you are happy with you product choice.

If the goods are excluded from your right to cancel under the Distance Selling Regulations (see previous paragraph) we will find out whether or not they have already been cut to your specifications and if they have not been cut we will accept a cancellation of your order and refund your money in full.
For goods purchased from our website that do come under the Distance Selling Regulations 2000 you have the right to cancel your order, up to 7 working days after you have received the goods. All returns and cancellations must conform to the guidelines laid out in the “Distance Selling Regulation” a guide of which can be found at www.oft.gov.uk/shared_oft/business_leaflets/general/oft698.pdf
If goods have not been dispatched we will refund you in full.
If you have taken delivery for your goods you must return the goods to us at your own expense following our authorisation. AllFloorsExpress can provide this return service – please contact us at sales@allfloorsexpress.co.uk to obtain a quote specific to your address. Returns will only be accepted within 30 days of receipt.
All goods must be re-packed exactly as they were received. Refunds will be made to the payment card that was initially used to make the purchase, within 30 days of cancellation.
To cancel your order you must inform us either in writing or by email at sales@allfloorsexpress.co.uk
After this statutory seven day ‘cooling off’ period, you have the protection of your statutory rights and the additional protection of the specific product guarantee detailed in the product description on the website. If you are unsure of your rights, please do not hesitate to seek advice from Trading Standards or other advisory body.
FAULTY OR WRONG GOODS
Wrong Goods
When your goods have been delivered you have a reasonable opportunity to make sure that they are the goods you ordered. You should not cut into, fit, or use them if you realise they are the wrong goods. You should retain the packaging so that this can be reused, if possible, for their return.You will be responsible for the condition of the goods and for their reasonable care whilst they are in your possession To report any error please either email us at sales@allfloorsexpress.co.uk or phone on 0845 1297971 within 7 days of delivery. We will arrange for any wrong goods to be replaced with the correct goods without charge to you.
Faulty Goods
If upon installation Goods are believed to be faulty then we will arrange for them to be inspected by the manufacturer and if found to be so we will repair or replace the goods where possible.You will be responsible for the condition of the goods and for their reasonable care whilst they are in your possession. To report any faulty goods please either email us at sales@allfloorsexpress.co.uk or phone on 0845 1297971 within 7 days of delivery. Your statutory rights are not affected by this condition.

FLOORING SPECIFIC CONDITIONS OF SALE

FLOORING PRODUCTS

Colour
We aim to reproduce the colours of our products as accurately as possible but please be aware that there may be a variation in shade between the reproduction on your monitor or printer and the actual article.

Measuring
You are responsible for ensuring that the quantity of any floorcoverings ordered is sufficient for your room. If your room is close to the nominal width of the carpet please allow extra in case a join is required. Our measurement guide provides guidance for measuring the room(s) you require flooring for.
If in any doubt please use the “ask the expert” icon on the website.

Carpets
Colours vary from batch to batch and exact matching between separate pieces (especially 4m and 5m rolls) cannot be guaranteed. All carpets are manufactured within a tolerance of plus or minus 1.25% in accordance with BS3655.
During transportation and storage pile may become slightly crushed and this will show as shaded bands across the pile. These will disappear as the carpet settles in to its new environment and as the pile is flexed through regular use and vacuum cleaning.

Carpets are soft, luxurious products and flattening of the pile will occur as a natural result of use. Flattening will change the apparent colour of the carpet (“shading”), may be permanent (“pile reversal”), and this may appear to be random, but this is not a fault. Areas where foot traffic twists and turns are especially prone to such changes in appearance. The sides of the pile appear a slightly different shade in colour to the ends and so any change in angle or direction of the pile may change the apparent colour of the carpet and this may be patchy. Such changes do not alter the durability of the carpet.

All carpets benefit from the use of a good quality underlay. Re-using existing underlay may result in abnormal flattening of the pile.

We recommend the use of vacuum cleaners with rotating brushes on cut pile carpets but suction-only for loop pile carpets.We recommend that all carpets and rugs are professionally cleaned periodically. The frequency will depend on the level of soiling, but should be done before soiling becomes ingrained into the pile fibres.

Spillages should be blotted up immediately. A proprietary carpet shampoo may be used for spot cleaning in accordance with the shampoo manufacturers’ instructions, but this should be tested before use in an inconspicuous area to ensure it will not harm the pile. Care should be taken not to scrub or agitate the pile which could cause it to lighten in colour. If in doubt, consult a professional cleaning company.

Vinyls
Vinyl floorcoverings should not be laid on top of existing vinyl flooring or tiles. Areas over 15 square metres should be fully stuck down using a suitable adhesive.
Vinyls are manufactured within a tolerance of plus or minus 1.25% in accordance with BS3655. If your room is close to the nominal width of the vinyl please allow extra material.

Wood & Laminate Flooring
Wood and Laminate flooring will be affected by moisture. Follow the suppliers fitting and maintenance instructions carefully to prevent swelling of the joints or other moisture-related problems.
We do not fit wood or laminate flooring. We recommend using a qualified joiner or specialist wood floor fitter.

FITTING
Fitting appointments are made in good faith but the exact arrival and duration times cannot be guaranteed due to the nature and unpredictability of the work involved. We cannot accept liability for delayed arrival, but you can be assured that the fitters will complete your work even if it exceeds the expected time allocation.

Fitters undertake to carry out their work with reasonable skill and care. New paintwork and wallpaper is especially vulnerable to minor damage during the fitting process and should be allowed to fully dry. A minimum of two weeks is recommended. Neither we nor any fitter undertake to carry out any redecoration, except where damage has been caused by that person’s negligence.

Doors may need to be trimmed to allow clearance. This is not part of the fitting work unless this has been specifically agreed by you and AllFloorsExpress.

Prior to fitting all furniture and existing flooring must be removed from the area to be fitted. To receive floorcoverings floors must be level, smooth and sufficiently dry to accept the type of floor to be fitted. It is your responsibility to ensure these things are done prior to fitting. If you are in any doubt as to what needs to be done prior to fitting please contact us on 0845 1297971 or use our “Ask The Expert” icon on the website. If fitting is not possible because the area is not prepared properly you may incur additional charges for wasted time, and suffer delays in completing the installation.

Intellectual property and right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Compliance with laws
The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:
any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance
If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire Agreement
These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding whatallfloorsexpress.co.uk and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by allfloorsexpress.co.uk.

We reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party.

Law
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
